Privacy Policy and Terms of Use

WHEREAS the website located at myspanishtravels.com (hereinafter "the Website") is owned, written and operated by a private individual known as Sroush, residing in the Kingdom of Norway (hereinafter "the Operator"); and WHEREAS the Operator holds the privacy of every visitor (hereinafter "the Visitor") in the highest regard; NOW, THEREFORE, the Operator does hereby ordain and establish the following Privacy Policy and Terms of Use, which shall govern all access to and use of the Website, and which every Visitor shall be deemed to have read and accepted by the act of using the Website.

  1. Article I. Of the Controller and the Governing Framework

    1. §1.1The Operator is the controller of any personal data processed through the Website within the meaning of Regulation (EU) 2016/679 (the General Data Protection Regulation, hereinafter "the GDPR"), as incorporated into the law of the Kingdom of Norway by the Personal Data Act (personopplysningsloven).
    2. §1.2All correspondence concerning this instrument, and every request made pursuant to it, shall be directed to the Operator at contact@myspanishtravels.com.

  2. Article II. Of Cookies and Like Technologies

    1. §2.1The Website places no cookies of any kind upon the device of the Visitor, whether for tracking, advertising, personalisation or any other purpose, and employs no tracking pixels, fingerprinting techniques or advertising networks.
    2. §2.2Consequently, the Website presents no cookie consent banner, there being no cookie to which consent could lawfully be sought.
    3. §2.3Where the Visitor elects to follow a link to a third party website, including the website of an affiliate partner, such third party may place its own cookies, and the Operator neither controls nor bears responsibility for the same.

  3. Article III. Of Analytics

    1. §3.1The sole analytics service employed by the Website is Ahrefs Web Analytics, provided by Ahrefs Pte. Ltd., which operates without cookies and, as represented by its provider, without storing personal data or tracking the Visitor across websites.
    2. §3.2Said service furnishes the Operator with aggregated and anonymous statistics only, such as the number of page views, the referring sources and the general region of visits, none of which permits the Operator to identify any individual Visitor.
    3. §3.3No other analytics, session recording, heatmap or behavioural profiling service is, or shall be, employed without prior amendment of this instrument.

  4. Article IV. Of Hosting, Delivery and Security

    1. §4.1The Website is served from servers operated by Hetzner Online GmbH within the European Economic Area, and is delivered through the network of Cloudflare, Inc. for the purposes of speed and protection against abuse.
    2. §4.2In the ordinary course of delivering any web page, these providers necessarily process the Internet Protocol address and technical request information of the Visitor, transiently and solely for the purposes of delivery, security and the prevention of attacks, on the basis of the legitimate interest of the Operator in a functioning and secure Website, pursuant to Article 6(1)(f) of the GDPR.

  5. Article V. Of the Newsletter

    1. §5.1Where the Visitor voluntarily submits an email address through a newsletter form on the Website, that address shall be transmitted by means of the service Resend, provided by Resend, Inc., to the private mailbox of the Operator, and shall be retained there for the sole purpose of sending the newsletter.
    2. §5.2The lawful basis of such processing is the express consent of the Visitor, pursuant to Article 6(1)(a) of the GDPR, which consent may be withdrawn at any time and without stating reasons, by replying to any newsletter or by writing to contact@myspanishtravels.com, whereupon the address shall be erased without undue delay.
    3. §5.3The Operator solemnly undertakes that the newsletter shall never, under any circumstances, be sent more than twice in any calendar month, and that no email address shall ever be sold, rented, shared or otherwise disclosed to any third party for any purpose whatsoever.

  6. Article VI. Of Transfers Beyond the European Economic Area

    1. §6.1Certain of the providers named herein, being Cloudflare, Inc. and Resend, Inc., are established in the United States of America. Any transfer of personal data to such providers shall take place only on the basis of appropriate safeguards as provided by Chapter V of the GDPR, including the EU-U.S. Data Privacy Framework or standard contractual clauses approved by the European Commission, as applicable.

  7. Article VII. Of the Rights of the Visitor

    1. §7.1Every Visitor whose personal data is processed shall enjoy the rights of access, rectification, erasure, restriction of processing, data portability and objection, together with the right to withdraw consent at any time, as enumerated in Articles 15 to 21 of the GDPR.
    2. §7.2Every Visitor shall further enjoy the right to lodge a complaint with the Norwegian Data Protection Authority (Datatilsynet), without prejudice to any other remedy available at law.
    3. §7.3The Operator does not sell personal data, does not engage in profiling, and makes no decision based solely on automated processing.

  8. Article VIII. Of Children

    1. §8.1The Website is not directed to children under the age of thirteen years, and the Operator does not knowingly collect personal data from any such child. Should it come to the attention of the Operator that such data has been received, it shall be erased forthwith.

  9. Article IX. Of the Terms of Use

    1. §9.1All content published upon the Website, including articles, reviews, guides, quizzes and images, is provided for purposes of general information and entertainment only, and is further subject to the provisions of the Disclaimer, which is hereby incorporated by reference.
    2. §9.2Save where otherwise indicated, all original text, images and graphics upon the Website are the exclusive intellectual property of the Operator. The Visitor may link to any page and may quote brief excerpts with clear attribution, but shall not republish any article or image in whole or in substantial part without the prior written permission of the Operator.
    3. §9.3The Website contains links to websites operated by third parties, over which the Operator exercises no control, and for whose content, policies and practices the Operator accepts no responsibility.
    4. §9.4Certain links upon the Website are affiliate links, the nature and consequences of which are set forth in full in the Affiliate Disclosure, which is hereby incorporated by reference.

  10. Article X. Of Governing Law and Amendment

    1. §10.1This instrument, and every dispute arising out of or in connection with the Website, shall be governed by and construed in accordance with the laws of the Kingdom of Norway, and shall be subject to the jurisdiction of the ordinary courts of Norway, without prejudice to any mandatory consumer protection afforded to the Visitor by the law of the Visitor's place of residence.
    2. §10.2The Operator reserves the right to amend this instrument at any time. Every amendment shall take effect upon publication on this page, and the date of the latest amendment shall be stated above. Should any new processing of personal data be introduced, this instrument shall first be amended to declare the same.
